Title
A resolution authorizing and directing the Council Chairman to forward a copy of this resolution to the St. Charles Parish District Attorney requesting an investigation into reported complaints and irregularities involving the St. Rose Volunteer Fire Department.
Body
WHEREAS,      two articles within the St. Charles Herald-Guide Newspaper during the weeks of March 20 - 26, 2008 and March 27 - April 2, 2008 and one article in the Times-Picayune on March 29, 2008 alleged inappropriate usages of public funds and property associated with the St. Rose Volunteer Fire Department; and,
WHEREAS,      the Council has no knowledge to date of any formal investigation with regards to these issues; and,
WHEREAS,      it is the desire of the Council to have the controversies pertaining to the St. Rose Volunteer Fire Department properly investigated and, hopefully, officially cleared of any improprieties.
NOW THEREFORE, BE IT RESOLVED, THAT WE, THE MEMBERS OF THE ST. CHARLES PARISH COUNCIL, do hereby authorize and direct the Council Chairman to forward a copy of this resolution to the parties named below within 24 hours, which shall:
1.      Request that the District Attorney immediately initiate an open, transparent investigation into the matters mentioned in articles in the St. Charles Herald-Guide Newspaper during the weeks of March 20 - 26, 2008 and March 27 - April 2, 2008 and in the Times-Picayune on March 29, 2008, and that this investigation include the reports made by citizens regarding the St. Rose Volunteer Fire Department.
2.      Request, in the alternative, that the District Attorney recuse himself from the case, and forward it to the Louisiana Attorney General's Office to allow for their investigation of this complaint in order to remove any possible perception that local politics could influence any findings or the outcome of the investigation.
BE IT FURTHER RESOLVED:
3.      That copies of this resolution be sent via U.S. Mail within 24 hours to U.S. Attorney Jim Letten, to FBI Special Agent Daniel Evans, to the St. Charles Parish President, and to the entire St. Charles Parish Council.
4.      That copies of the referenced articles in the St. Charles Herald-Guide newspaper during the weeks of March 20 - 26, 2008 and March 27 - April 2, 2008 and the article in the Times-Picayune on March 29, 2008 accompany copies of this resolution when sent to the parties named in this resolution.
