ORDINANCE NO. 11-4-38
Title
An ordinance to amend the 2011 Consolidated Operating and Capital Budget to add Judgments and Damages for fund 112 - Roads and Drainage - Drainage account 112-420260 in the total amount of $1,355,000 from the Unreserved Fund Balance of Fund 112 - Drainage for the purpose of paying the Judgment rendered in The Parish of St. Charles vs. R.H. Creager, Inc. et al, No. 37,030, 29th Judicial District Court for the Parish of St. Charles.

WHEREAS, the 2011 St. Charles Parish Consolidated Operating and Capital Budget was adopted November 8, 2010 by Ordinance No. 10-11-1, amended February 2, 2011 by Executive Order No. 11-1; February 3, 2011 by Executive Order No. 11-2; March 21, 2011 by Amendment #1, #2 & #3 still awaiting approval; and April 18, 2011 by Amendment #4 still awaiting approval; and,
WHEREAS, the Council has taken under consideration the study of the amendment to the St. Charles Parish Consolidated Operating and Capital Budget for fiscal year 2011 as shown by the Revision Schedule.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That in accordance with the provisions of Article V, Sections D, E, and F of the St. Charles Parish Home Rule Charter and with the Louisiana Local Government Budget Act (R.S. 39:1301 et. seq.), the St. Charles Parish Council does hereby amend the 2011 St. Charles Parish Consolidated Operating and Capital Budget, as amended, as per "Exhibit A".

The foregoing ordinance having been submitted to a vote, the vote thereon was as follows:
YEAS: SCHEXNAYDRE, AUTHEMENT, RAYMOND, TASTET, BENEDETTO, HOGAN, COCHRAN, LAMBERT, NUSS
NAYS: NONE
ABSENT: NONE
And the ordinance was declared adopted this 18th day of April , 2011, to become effective five (5) days after publication in the Official Journal.
