An ordinance to amend and/or supplement the Code of Ordinances, Chapter 3 Alcoholic Beverages, Article I. In General, Section 3-1(c) - Location restrictions; Section 3-4(c) - Consumption in public buildings prohibited; Section 3-6 - Consumption of alcoholic beverages in parking lots prohibited.

Body

THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:

                     SECTION I.  That the Code of Ordinances, Chapter 3 Alcoholic Beverages, Article I. In General, Section 3-1-Location restrictions, with new text underlined and deleted text in strikethrough as follows:

                     Sec. 3-1. Location restrictions.

(c)  The provisions of this section do not apply to any premises which are maintained as a bona fide hotel, railway cars, or fraternal organization, nor to any licensed drugstores which are licensed under state law to sell alcoholic beverages.  The provisions of this section shall not apply to any premises which has been licensed to deal in alcoholic beverages prior to the adoption of this section.

(c)  The Location Restrictions set forth and contained in this Section 3-1 shall not apply to the following premises/locations which said premises/locations are specifically excluded therefrom, to-wit:

(i)                     any premises/locations maintained as a bona fide hotel;

(ii)                     railway cars;

(iii)                     premises/locations owned, leased and/or operated by fraternal organizations;

(iv)                     licensed drugstores which are licensed under state law to sell and or deal in alcoholic beverages;

(v)                     the Edward J. Dufresne Community Center;

(vi)                     the LaFon Performing Arts Center; and

(vii)                     any premises/locations which were licensed to sell and/or deal in alcoholic beverages on or prior to December 19, 1983.

                     Sec. 3-4. Consumption in public buildings prohibited.

(c)  Any person violating the provisions of this section shall be punished by a fine of not more than two hundred fifty dollars ($250.00) or imprisonment in the parish jail for not more than thirty (30) days, or both, at the discretion of the court.

(c)  The consumption restrictions set forth and contained in Section 3-2 and this Section 3-4 shall not apply to either the Edward J. Dufresne Community Center or the Lafon Performing Arts Center and the legal lots of record on which said facilities are situated.

(d)  Any person violating the provisions of this section shall be punished by a fine of not more than TWO HUNDRED FIFTY AND NO/100 ($250.00) DOLLARS or imprisonment in the Parish Jail for not more than thirty (30) days, or both, at the discretion of the Court.

                     Sec. 3-6. Consumption of alcohol beverages in parking lots prohibited.

(f)  Exclusions: The prohibitions contained in this section shall not apply to country clubs.

(f)  Exclusions: The prohibitions contained in this Article shall not apply to:

                     (i)                     Country Clubs;

                     (ii)                     the Edward J. Dufresne Community Center;

                     (iii)                     the LaFon Performing Arts Center.

                     The foregoing ordinance having been submitted to a vote, the vote thereon was as follows:
