Title

Body

WHEREAS,                     the Sunset Drainage District levee is an integral part of the West Bank Hurricane Protection Levee System in St. Charles Parish; and,

WHEREAS,                     the recent survey taken along the Sunset Drainage District levee centerline shows that several locations have elevations that fall below elevation 5.0’; and,

WHEREAS,                     the low areas along the Sunset Drainage District levee puts people and property within the District at risk during a storm event; and,

WHEREAS,                     these low areas will be inaccessible for interim protection measures during a storm event; and,

WHEREAS,                     raising the low areas would provide increased protection to the Sunset Drainage District until such a time that the levee is rebuilt to FEMA flood protection standards; and,

WHEREAS,                     Ordinance No. 14-10-10 was adopted on October 6, 2014 which approved and authorized the execution of a Cooperative Endeavor Agreement (CEA) between St. Charles Parish and the Sunset Drainage District to define the respective rights, duties, responsibilities, and liabilities; and,

WHEREAS,                     the CEA states that the purpose and intent of the agreement is to authorize the Parish to administer, manage, fund, implement, operate, maintain, provide, utilize, police, repair, replace, construct, and or rehabilitate earthen levees, bulkheads, embankments, canals, floodwalls, floodgates, temporary pumps, pumping stations and associated buildings and any servitudes or easements associated with these items located within the Sunset Drainage District; and,

WHEREAS,                     the Public Works Director informed the citizens that attended the millage meeting at the Bayou Gauche Volunteer Fire Department that the Parish can raise the low areas along the levee as requested by one of the citizens in attendance; and,

WHEREAS,                     the voters of the Parish voted to dedicate a certain millage to provide for the purpose of paying any costs associated with constructing, acquiring, maintaining, operating, extending and/or improving levees, facilities and structures associated with outer flood protection systems within the Parish; and,

WHEREAS,                     it is the desire of the St. Charles Parish Council, acting as the Governing Authority of the Sunset Drainage District, that the low areas be raised as noted herein.

NOW THEREFORE, BE IT RESOLVED THAT WE, THE MEMBERS OF THE ST. CHARLES PARISH COUNCIL, acting as the Governing Authority of the Sunset Drainage District, do hereby request that the Administration design and put out for bid in 2015 an interim project to raise the crown of the Sunset Drainage District levee in the low areas along Grand Bayou so as to provide for a minimum protection of elevation 5.0’ with a 1.0’ overbuild in the areas that are currently below elevation 5.0’, and that an elevation of at least 5.0’ be maintained at all times along Grand Bayou until such a time that this and all other Sunset Drainage District levee sections are improved so as to meet current FEMA flood protection standards, and to place in the draft 2016 budget funds to perform this work in 2016 should it not be feasible to be performed in 2015.

The foregoing resolution having been submitted to a vote, the vote thereon was as follows:
