Title
An ordinance of the Parish of St. Charles, providing that the Code of Ordinances, Parish of St. Charles, Chapter 2 Administration, Article I. In General, be amended by adding Section 2-16.7. Complainant Non-Disclosure.
Body
WHEREAS, it is the desire of the Parish Council to prohibit any Parish employee from directly disclosing the name of individuals filing complaints (i.e., grass, trash, junk, etc.); and,
WHEREAS, it is the desire of the Parish Council that the release of such information by a St. Charles Parish employee be strictly prohibited by any means other than through a public information request; and,
WHEREAS, it is the desire of the Parish Council that disciplinary action be taken against any employee that fails to follow this protocol.
NOW, THEREFORE BE IT ORDAINED, THAT WE, THE MEMBERS OF THE ST. CHARLES PARISH COUNCIL, do hereby amend the Code of Ordinances, Parish of St. Charles, Chapter 2. Administration, Article I. In General, by adding Section 2-16.7. Complainant Non-Disclosure.
Section 2-16.7. Complainant Non-Disclosure
(a) All Parish employees shall provide the following statement to the public in the event that they are asked to identify the individual(s) or entity, should any exist, with regards to the employee addressing code violations: "Per St. Charles Parish regulation, I am not at liberty to discuss anything more than the violation(s) with you. As with all public records, all information relating to this violation(s) is available through a formal public records request.".
(b) All Parish employees shall be provided written notice of the adoption of this ordinance. All employees shall be required to sign and date for receipt of notice. The original signed and dated notice shall be placed in the employee's employment records. All employees shall be required to submit the signed and dated notice within 30 days of the adoption of this ordinance.
(c) Any Parish employee found to have violated this ordinance shall be faced with disciplinary action per the Civil Service Rules and Regulations and/or their respective Department Policy. Department policies regarding such violations shall be developed by each Department, shall put into written words, shall be adopted in writing, shall be presented to each employee, and shall be provided to the Council Secretary and the Parish Personnel Officer within 14 days following adoption of this ordinance and within 7 days of any subsequent changes to the initial adopted policies.
