Title
An ordinance amending Chapter 16 “Nuisances”, Section 16-25 (b), Section 16-26 (a) and Section 16-27 of the St. Charles Parish Code of Ordinances relative to “Prohibited”, “Notice to abate” and “Abatement by Parish”, in St. Charles Parish.
Body
WHEREAS, uncut grass and weeds on properties in St. Charles Parish continues to be a problem and an eyesore within the Parish; and,
WHEREAS, State law was recently changed to reduce the notice delay from fifteen (15) days to five (5) days; and,
WHEREAS, it would be in the best interest of St. Charles Parish to amend the Code of Ordinances to bring it into conformity with the new State law.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That Section 16-25 “Prohibited”, Section (b) is hereby amended to read as follows:
(b) It shall be unlawful for the owner, or his agent, of any undeveloped residential property within the parish lying within areas subdivided into squares/lots to permit the growth of tall grass and/or weeds upon the entire area of the subject property. It shall also be unlawful for the owner or his agent to allow the accumulation of trash upon the entire area of the subject property.
SECTION II. That Section 16-26 “Notice to abate”, Section (a) & (b) is hereby amended to read as follows:
(a) By Mail: The parish shall notify, by registered or certified mail, the owner, or his agent, of any property on which tall grass and/or trash may be located in violation of section 16-25, to cut, destroy or remove such tall grass and/or trash from the premises involved, which notice shall be sent to the owner of such property (as shown on the latest assessment rolls of the parish) or his agent. This notice will identify the property and notify the owner or his agent to perform any necessary work at his own expense within five (5) days after receipt of the notice.
