ORDINANCE NO. 02-7-8
Title
An ordinance to enact a MORATORIUM on any construction near the Ormond Center Canal which will remain in effect until adequate and safe drainage infrastructure is installed; and Parish servitude along this Canal is obtained.
Body
WHEREAS, future development of the Ormond Center in St. Charles Parish has the potential to have detrimental and negative impact on the public health, welfare, safety and well being of the citizens of St. Charles Parish, in particular; residents of New Sarpy and Destrehan; and,
WHEREAS, the public trusts its elected officials to protect them and to act in the best interest of the people they represent; and,
WHEREAS, there are many unanswered questions regarding the impact this development would have on the surrounding area; and,
WHEREAS, the St. Charles Parish Council in 1996 did not object to the development provided the Canal was adequately improved; and,
WHEREAS, in recent months St. Charles Parish Council has taken action to study the drainage in this area and has learned that 2-72” culverts are to be placed before the Schexnaydre Pump Station and the Canal was closed with installation of 1-60” culvert to handle this water flow; and,
WHEREAS, a 30' servitude required has not been given to the Parish by the developer; and,
WHEREAS, in order to allow the members of the St. Charles Parish Council and the Administration sufficient time to address this complex issue, it is necessary to impose a moratorium on any construction of development in this area until the servitude is granted by developer and conflicts in drainage culverts or resolved to the St. Charles Parish Council approval.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That a MORATORIUM is hereby placed on the permitting of any and all related construction, per Appendix A & B of the Code of Ordinances.
