Title
An ordinance to approve and authorize the execution of a contract with Fleming Construction Company, Inc. for the construction of Project P990504 Boutte Drainage Project in the amount of $319,809.00.
Body
WHEREAS, sealed bids were received by the Parish on December 7, 2001, for Boutte Drainage Project; and,
WHEREAS, an injunction was filed against St. Charles Parish by Civil Construction, L.L.C., the second lowest bidder, to prevent award of the contract to the lowest bidder, Fleming Construction Company, Inc.; and,
WHEREAS, the Fifth Circuit Court of Appeal determined the injunction to be null and set it aside on November 26, 2002; and,
WHEREAS, all applicable time periods for appeals have expired; and,
WHEREAS, Barowka & Bonura Engineers & Consultants, L.L.C. for the Project, have reviewed the bids and recommend that the Contract be awarded to the low bidder, Fleming Construction Company, Inc. in the amount of $319,809.00.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That the bid of Fleming Construction Company, Inc. for the construction of Boutte Drainage Project be hereby accepted in the amount of $319,809.00.
SECTION II. That the Parish President is hereby authorized to execute the attached contract documents.

The foregoing ordinance having been submitted to a vote, the vote thereon was as follows:
And the ordinance was declared adopted this ______ day of ____________, 2003, to become effective five (5) days after publication in the Official Journal.
