Title
An ordinance to rescind Ordinance No. 17-8-15 which approved the Donation of Servitude by Mary Keller wife of/and Neal J. Clulee to St. Charles Parish.
Body
WHEREAS, on August 28, 2017, Ordinance No. 17-8-14 was adopted by the St. Charles Parish Council approving and authorizing the execution of Lease Agreement between St. Charles Parish and Gator Cove Marina II, LLC for a Westbank Boat Launch: and,
WHEREAS, the Parish President approved the ordinance on August 31, 2017 and executed the lease on August 31, 2017; and,
WHEREAS, on the same day the lease ordinance was adopted by the Council, Ordinance No. 17-8-15 was also adopted by the Council which approved the Donation of Servitude by Mary Keller wife of/and Neal J. Clulee to St. Charles Parish to provide the necessary access to the leased property; and,
WHEREAS, the Parish President approved the ordinance on August 31, 2017 but never executed the lease as he was required to do unless he would have elected to veto the ordinance which he did not; and,
WHEREAS, on September 13, 2017, The Gator Cove Marina II, LLC lease agreement was cancelled; and,
WHEREAS, since the said lease agreement was cancelled, the servitude agreement which the Parish President failed to execute is no longer needed; and,
WHEREAS, it is therefore the desire of the St. Charles Parish Council to rescind Ordinance No. 17-8-15.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That Ordinance No. 17-8-15 adopted on August 28, 2017, is hereby rescinded.
The foregoing ordinance having been submitted to a vote, the vote thereon was as follows:
And the ordinance was declared adopted this _____ day of ________ , 2018, to become effective five (5) days after publication in the Official Journal.
