Title
An ordinance to amend the Code of Ordinances, Appendix A to further define "Sanitary Landfill" and make it a Special Permit Use in an M-3 Zoning District.
Body
WHEREAS, the current definition of a Sanitary Landfill is vaguely written and in need of revision; and,
WHEREAS, due to the intense nature of Landfills they should be only allowed in M-3 Zoning Districts and removed from the M-2 Zoning District.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That the St. Charles Parish Code, Appendix A, Section III, Number 61, Sanitary Landfill is hereby amended to read as follows:
61.Sanitary Landfill. This term includes the following:
(a) That definition presently afforded to it in the Regulations promulgated by the Louisiana Department of Environmental Quality (Title 33, Louisiana Revised Statutes, Section VII);
(b) Any Land Area and/or Transfer Station and/or Staging Area, and/or Loading/Unloading Area, and/or Holding Area and/or Storage Area for the temporary or permanent storage of Solid Waste and/or the compacting and/or Packaging and/or processing of Solid Waste;
(c) For purposes of this Section, the term "Solid Waste" shall mean (1) the definition given to it in the presently existing Regulations promulgated by the Louisiana Department of Environmental Quality and shall also include (2) toxic and hazardous materials; (3) asbestos and regulated asbestos contaminated materials; (4) Construction/Demolition Debris, as that term is defined in the Regulations promulgated by the Louisiana Department of Environmental Quality (Title 33, Louisiana Revised Statutes, Section VII); and (5) Industrial Solid Waste, as that term is defined in the Regulations promulgated by the Louisiana Department of Environmental Quality (Title 33, Louisiana Revised Statutes, Section VII).
