An ordinance amending Chapter 3 Alcoholic Beverages of the Code of Ordinances for St. Charles Parish to add under Article II. License, Section 3-15 (d) Hours of Operation, Penalties.

WHEREAS, businesses dispensing alcoholic beverages are operating in residential areas; and,
WHEREAS, loud music, fighting, and excessive drinking is disruptive to residential communities.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That the Code of Ordinances, Chapter 3 Alcoholic Beverages, Article II. License, Section 3-15 is hereby amended by adding the following:
(d) Hours of Operation, Penalties
(1) No person holding a permit or license to operate a business in St. Charles Parish for the sale of alcoholic beverages of high or low alcoholic content, his/her associate, representative, servant, agent or employee of the permittee or lilcensee shall do or permit any of the following acts to be done on or about the licensed premises:
(a) Sell, offer for sale, serve or give alcoholic beverages of high or low alcoholic content between the hours of 2:00 a.m. and 6:00 a.m. on all days, except as exempted in (2) below.
(b) Allow the possession or consumption of alcoholic beverages on the premises between the hours of 2:00 a.m. and 6:00 a.m. on all days.
(c) Allow anyone except employees to be or remain on the premises between 2:00 a.m. and 6:00 a.m. when the sale or handling of alcoholic beverages constitutes the main business.
(2) This section exempts the following days from the curfew hours:
(a) Christmas Eve;
(b) Christmas Day;
(c) New Year's Eve;
(d) New Year's Day;
(e) Fourth of July; and
(f) Any other days exempted by the vote of the Council or by Proclamation of the Parish President.
