Title
An ordinance to approve and authorize the execution of the First Amendment to Wetlands Mitigation Agreement by and between St. Charles Parish and Delta Land Services, L.L.C. in the revised amount of $1,395,000.00 to provide wetlands mitigation for the West Bank Hurricane Protection Levee, Phase III - ELLINGTON.
Body
WHEREAS, the St. Charles Parish Council adopted Ordinance No. 15-4-15 on April 20, 2015, approving a Wetlands Mitigation Agreement with Delta Land Services, L.L.C., to provide wetlands mitigation for the West Bank Hurricane Protection Levee, Phase III - ELLINGTON; and,
WHEREAS, St. Charles Parish has received the final mitigation requirements for U.S. Army Corps of Engineers Permit No. MVN-2010-2326-EOO that would authorize the West Bank Hurricane Protection Levee, Phase III - ELLINGTON which requires the purchase of 4.0 acres of Bottomland Hardwood and 27.0 acres of Cypress Swamp credits from the Laurel Valley Coastal Mitigation Bank located in Lafourche Parish; and,
WHEREAS, the First Amendment to said Agreement revises the acres to be purchased under the Wetlands Mitigation Agreement to match the U.S. Army Corps of Engineers permit requirements; and,
WHEREAS, the First Amendment to said Agreement revises the total amount of compensation due to $1,395,000.00 to match revised number of acres being required by the U.S. Army Corps of Engineers; and,
WHEREAS, it is the desire of the Parish Council to approve said First Amendment to the Wetlands Mitigation Agreement to comply with the requirements of U.S. Army Corps of Engineers Permit No. MVN-2010-2326-EOO.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
