Title
An ordinance to amend the Code of Ordinances for St. Charles Parish, Chapter 24. Noise, Section 24-4. Maximum permissible sound limits to add (d), prohibit noise from private garbage collection.
Body
WHEREAS, excessive loud noises are declared a nuisance; and,
WHEREAS, on July 20, 2009, the St. Charles Parish Council adopted Ordinance No. 09-7-12 amending the Code of Ordinances for St. Charles Parish, to add Chapter 24. Noise, which would outline specific conditions associated with noise and allow Law Enforcement Officials to address the needs of the Residents; and,
WHEREAS, the emptying of dumpsters and collecting refuse and rubbish at all hours of the early morning is a nuisance to residents living in close proximity to any dumpsters; and,
WHEREAS, it is in the best interest of the Residents of St. Charles Parish that we restrict garbage collection to certain hours of the day to not disturb residents.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That the Code of Ordinances, Chapter 24. Noise, Section 24-4. Maximum permissible sound limits be amended by adding (d):
CHAPTER 24. NOISE.
Section 24-4. Maximum permissible sound limits.
(d) No maximum permissible sound limit exist with respect to any private garbage collection, however; no private garbage collection shall occur between the hours of 8:00 p.m. and 6:00 a.m. when said collection is within five-hundred (500) feet of any residence, hospital, and nursing home.
The foregoing ordinance having been submitted to a vote, the vote thereon was as follows:
And the ordinance was declared adopted this ____ day of ____________, 2015, to become effective five (5) days after publication in the Official Journal.
