Title
An ordinance to authorize the Parish President to make full and final settlement in the matter entitled "St. Charles Parish v. Aegis Construction, Inc. and Duplantis Design Group, PC.", 29th Judicial District Court, Parish of St. Charles, No. 84389.
Body
WHEREAS, St. Charles Parish filed a Petition for Damages alleging that Duplantis Design Group, PC failed to properly design the St. Charles Parish EOC building, and that Aegis Construction, Inc. failed to properly construct the St. Charles Parish EOC building; and,
WHEREAS, in the same litigation, St. Charles Parish filed a Supplemental Petition for Damages alleging that Gulf Equipment Corporation of Alabama failed to properly design and construct the communications tower adjacent to the St. Charles Parish EOC building and that MS Benbow and Associates failed to provide adequate engineering services for the communications tower and the St. Charles Parish EOC building; and,
WHEREAS, the parties have agreed to compromise and make a full and final settlement; and,
WHEREAS, the defendants have agreed to pay $325,000.00 to St. Charles Parish, inclusive of all damages, costs and fees in exchange for a full release by St. Charles Parish for all claims asserted in this litigation against all parties.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That the President of St. Charles Parish is hereby authorized to settle the matter entitled "St. Charles Parish v. Aegis Construction, Inc. and Duplantis Design Group, PC.", 29th Judicial District Court, Parish of St. Charles, No. 84389 by accepting payment of $325,000.00 from the defendants, payable to St. Charles Parish, in exchange for a full and final release of all claims against all parties.
