RESOLUTION NO. 4858
Title
A resolution authorizing the Chairman or the Secretary to offer OBJECTION to THE MITCHELL COMPANY, INC., COE EF-20-000-1578, WQC #000601-09 for a permit to clear, grade, excavate, deposit and maintain fill to construct Ormond Country Club Estates Section 12, which will include single family lots, driveways, yards, utilities and access roads, off of Nottaway Drive, Destrehan, in St. Charles Parish, Louisiana.

BE IT RESOLVED by the St. Charles Parish Council acting as the Governing Authority of the Parish:
SECTION I. That the Chairman or the Secretary be and is hereby authorized to offer an OBJECTION in connection with the application of The Mitchell Company, Inc., for a permit to clear, grade, excavate, deposit and maintain fill to construct Ormond Country Club Estates Section 12, which will include single family lots, driveways, yards, utilities and access roads, off of Nottaway Drive, Destrehan, in St. Charles Parish, Louisiana.
SECTION II. That the offer of OBJECTION is issued for the following reasons:
A) All permitting processes have expired and there is no grandfathering on the time limit permitting 404 process.
B) Applicant has to start under new 404 permit application requirements.
C) The citizens in the vicinity have appeared before the Council conveying their strong objection.
D) It is deemed low lying wetland and if filled, raised, and built up the new development will flood already existing neighborhoods.
E) The existing drainage system cannot handle the new development without major study.
F) Right-of-ways on the drainage canal banks have no sufficient land area to support fencing or the necessary flood protection mechanisms for the new development.
SECTION III. That a copy of this resolution shall be forwarded to all interested parties.
