ORDINANCE NO.
An ordinance of the Parish of St. Charles, providing that the Code of Ordinances, Parish of St. Charles be amended by revising Chapter 21, Article I, Section 21-1(e) to provide an exception to the prohibition of the installation of culverts in subdivisions designed and accepted by the Parish with open swale/ditch drainage systems for District IV, District I, District II, District VI, Oak Manor Estates, and Oak Lawn Ridge Estates.
Body
WHEREAS, the open ditch method of drainage as opposed to sub-surface drainage, is an expensive burden for the taxpayers of St. Charles Parish; and,
WHEREAS, open ditches must be constantly maintained, cleaned, cleared of trash, garbage and accumulated sediment in order to flow efficiently; and,
WHEREAS, standing water in open ditches provides a breeding habitat for mosquitoes, snakes, rats, and other varmints, thereby requiring constant pest control; and,
WHEREAS, sub-surface drainage systems are aesthetically pleasing, improve the appearance of a neighborhood and increase property values; and,
WHEREAS, numerous residents are being allowed to close ditches in neighborhoods developed prior to January 1, 1992; and,
WHEREAS, residents owning property and living in District IV subdivisions constructed after January 1, 1992 are requesting permission to close in ditches; and,
WHEREAS, in order to fairly represent all citizens in St. Charles Parish, culvert installation should be allowed in all open swale/ditch subdivisions.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That the St. Charles Parish Code of Ordinances, Chapter 21, Article I, Section 21-1(e) is hereby amended as follows:
