ORDINANCE NO. __________
Title
An ordinance to enact a MORATORIUM on the approval of major subdivisions (more than five lots) in Montz until June 30, 2009.
Body
WHEREAS, the further development of major subdivisions in Montz has the potential to have detrimental and negative impacts on the public health, welfare, safety, well being, and property interest of residents from the potential hazards of adverse effects of proper sewer, drainage, and other infrastructure issues; and,
WHEREAS, in order to protect and preserve the health, welfare, safety, well being, and property interest of residents of Montz it is necessary to impose a Moratorium on the development of major subdivisions within the District to allow for the adoption of legislation to assure that new development contributes its proportionate share of the cost of providing improvements to the Drainage system of the District.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That there is hereby imposed a Moratorium on the development of major subdivisions (more than five lots) in Montz.
SECTION II. That this Moratorium shall affect all properties, regardless of zoning, within the boundaries Montz.
SECTION III. That this Moratorium shall apply to any major subdivisions, which have not received preliminary plat approval from the St. Charles Parish Planning & Zoning Commission prior to the adoption of this ordinance.
SECTION IV. That the Moratorium hereby imposed shall be in effect until June 30, 2009.
