Title
An ordinance to amend Ordinance No. 01-7-1, a contract with Angelo Iafrate Construction, LLC for the construction of Project P000801, Road Overlay 2000 – 2001, to change the retainage withheld and payments made by St. Charles Parish in the payment amount of ninety-five percent (95%) in accordance with statute La. R. S. 38:2248 of the Louisiana Public Bid Law.
Body
WHEREAS, Section 00500, Article 5.2 of the current contract agreement with Angelo Iafrate Construction, LLC, for the construction of Project P000801, Road Overlay 2000 – 2001, states that the retainage withheld and payments made by Owner (St. Charles Parish) in the amount of ninety percent (90%) of the approved payment applications,
WHEREAS, the contract with Angelo Iafrate Construction, LLC, for the construction of Project P000801, Road Overlay 2000 – 2001 is in the amount of $1,146,632.87,
WHEREAS, statute, La. R.S. 38:2248, states that retainage withheld for public contracts in excess of five hundred thousand dollars ($500,000) shall not exceed five percent (5%).
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That Ordinance No. 01-7-1, a contract with Angelo Iafrate Construction, LLC, for the construction of, Project P000801, Road Overlay 2000 – 2001, Section 00500, Article 5.2, be amended by deleting ninety percent (90%) and replacing it with ninety-five percent (95%).
SECTION II. That the Parish President is hereby authorized to execute the attached amended contract documents.
