Title
An ordinance amending the St. Charles Parish Code of Ordinances, Appendix A, Section X. G.2.c. to modify the setback requirements for telecommunications towers.
Body
WHEREAS, the Zoning Ordinance sets forth a procedure for the construction and/or operation of cellular and personal communications service; and,
WHEREAS, in order to protect the public health, safety, and welfare of St. Charles Parish, the debris from failure of monopole tower, mast, aerial, or antennae shall be contained within tower site; and,
WHEREAS, containment of debris within site will ensure protection of the abutting property owner(s).
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That the St. Charles Parish Code of Ordinances, Appendix A, Section X.G.2.c. is hereby amended to read as follows:
c. Setbacks. Cellular and PCS installations shall be setback from all abutting property lines by a distance of one hundred (100%) percent of the height of design point of failure of the servicing tower, monopole tower, mast, aerial, or antennae, plus twenty five feet (25'). Applicant shall submit documentation, certified by a registered professional engineer licensed to practice in the State of Louisiana that accurately specifies this point of failure. If the applicant fails to provide such certified documentation of the design point of failure, the installation shall be setback from all abutting property lines by a distance of one hundred (100%) percent of the height of the servicing tower, monopole tower, mast, aerial, or antennae, plus twenty five feet (25'). Communications equipment shelters, which service the installation, shall adhere to standard setback requirements for the affected zoning district.
