Title
A resolution stating St. Charles Parish's interest in participation in the Louisiana Enterprise Zone Program and designation of Enterprise Zones.
Body
WHEREAS, the Louisiana Enterprise Zone Act 901 of 1981, Act 337 of 1982, Act 433 of 1987, Act 1024 of 1992, Act 581 of 1995, Act 624 of 1997, and Act 647 of 1997, and Act 977 of 1999; and,
WHEREAS, the Louisiana Enterprise Zone Program offers significant incentives for economic development within the State; and,
WHEREAS, the Parish of St. Charles has a 1990 population of less than 75,000 and is allowed by Act 581of 1995 and Act 647 of 1997 to designate one additional area that would not otherwise qualify as an Enterprise Zone; and,
WHEREAS, in accordance with the Louisiana Enterprise Zone Program requirements the Parish of St. Charles agrees:
1. To participate in the Enterprise Zone Program.
2. To assist the department in evaluating progress made in any Enterprise Zone within its jurisdiction.
3. To REBATE all applicable local sales/use taxes on the purchase of eligible construction materials, machinery, and equipment purchased and used by the business permanently on that site for projects endorsed by this body.
NOW, THEREFORE, BE IT RESOLVED, THAT WE, THE MEMBERS OF THE ST. CHARLES PARISH COUNCIL do hereby request designation by the Louisiana Department of Economic Development of Census Tract 621 and Block Group 001 as an Enterprise Zone.
BE IT FURTHER RESOLVED if any provision or item of this resolution or the application thereof is held invalid, such invalidity shall not affect other provisions, items or applications of this resolution which can be given effect without the invalid provisions, items or applications and to this end the provisions of this resolution are hereby declared severable.
