Title
An ordinance to approve and authorize the execution of an Predial Servitude Agreement by and between Rathborne Land Co. LLC and St. Charles Parish for property adjacent to the Luling Oxidation Pond.
Body
WHEREAS, St. Charles Parish is in need of a flowage easement to fulfill the requirements of LDEQ Oxidation Pond Permit No. LA0032131, AI No. 43356; and,
WHEREAS, Rathborne Land Co. LLC agrees to grant to St. Charles Parish a flowage easement for the purpose of discharging treated effluent from the Luling Oxidation Pond into the wetlands area per attached Agreement.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That the Predial Servitude Agreement described above is hereby approved.
SECTION II. That the Parish President is hereby authorized to execute said Predial Servitude Agreement on behalf of St. Charles Parish.
