Title
An ordinance to approve and authorize Amendment No. 3 to the Intergovernmental Agreement between the Coastal Protection and Restoration Authority of Louisiana and St. Charles Parish for the St. Charles West Bank Hurricane Protection Levee Project (BA-85).
Body
WHEREAS, on December 17, 2007, the St. Charles Parish Council adopted Ordinance No. 07-12-24 approving and authorizing the execution of a Cooperative Endeavor Agreement with the State of Louisiana Department of Transportation and Development (LADOTD) to provide a maximum of $4,500,000.00 for the St. Charles West Bank Hurricane Protection Levee - Phase I Magnolia Ridge, State Project No. 579-45-0001; and,
WHEREAS, on December 6, 2010, the St. Charles Parish Council adopted Ordinance No. 10-12-9 approving Amendment No. 1 to transfer all rights, responsibilities, and obligations of the LADOTD to the Coastal Protection and Restoration Authority (CPRA) via Intergovernmental Agreement, to change the State Project Number to OCPR-BA-85, to change the Project Description due to more imminent aspects of the St. Charles West Bank Hurricane Protection Levee Project, and to allow for the relocation costs for a St. Charles Parish owned waterline associated with the West Bank & Vicinity Hurricane Protection Project (WBV-73); and,
WHEREAS, on October 7, 2013, the St. Charles Parish Council adopted Ordinance No. 13-10-6 approving Amendment No. 2 to said Agreement, for the CPRA Board through the CPRA to provide a maximum of $2,000,000.00 in additional funding for said project; and,
WHEREAS, the CPRA has prepared Amendment No. 3 to said Agreement, for the CPRA Board through the CPRA to provide a maximum of $8,000,000.00 in additional funding for the Ellington Plantation portion of the project; and,
WHEREAS, it is the desire of the Parish Council to approve Amendment No. 3.
