Title
An ordinance to approve Amendment No. 1 to the Joint Use Agreement with the Department of Transportation and Development for the West Bank Bicycle/Pedestrian Path Trailhead and the West Bank Bridge Park Expansion.
Body
WHEREAS, the St. Charles Parish Council adopted Ordinance No. 83-5-4 on May 2, 1983 which approved a Joint Use Agreement (No.45) with the Louisiana Department of Transportation and Development for the East and West Bank Bridge Parks; and,
WHEREAS, the Parish has requested that said Joint Use Agreement be amended to include an additional 200'x869' foot tract along the rear of the West Bank Bridge Park, adjacent to the railroad track, and one additional tract between LA18 and the Mississippi River Levee for the West Bank Bicycle/Pedestrian Path Trailhead; and,
WHEREAS, the Louisiana Department of Transportation and Development has agreed to amend its Joint Use Agreement with the Parish to allow for the use of said property; and,
WHEREAS, it is the desire of the Parish Council to approve said amendment.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That Amendment No. 1 to Joint Use Agreement No. 45 State of Louisiana, Department of Transportation and Development and St. Charles Parish is hereby approved.
SECTION II. That the Parish President is hereby authorized to execute said Amendment No. 1 to Joint Use Agreement No. 45 on behalf of St. Charles Parish.
