Title
An ordinance to amend the Code of Ordinances Chapter 15, Motor Vehicles and Traffic, Section 15-5.1. Engine brake (unmuffled compression brake) (a) to add (4) a "No Unmuffled Compression Brake" area on a stretch of Highway 90 in Boutte near I-310.
Body
WHEREAS, the practice of engine braking by diesel trucks (sometimes referred to as "Jake Brake"), creates disturbing, excessive and offensive noise when they are used; and,
WHEREAS, this problem has become a nuisance to the residents in the area on Highway 90 in Boutte near I-310; and,
WHEREAS, the location of where signs are to be placed noting the prohibition of the use of engine braking is shown on the drawing attached to and made a part of this ordinance; and,
WHEREAS, "UNMUFFLED COMPRESSION BRAKES PROHIBITED" signs shall be posted off each shoulder of Highway 90 in accordance with Louisiana Department of Transportation and Development requirements.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That the Code of Ordinances, Chapter 15 Motor Vehicles and Traffic, Section 15-5.1. Engine brake (unmuffled compression brake) (a) be hereby amended as follows with new text underlined and deleted text in strikethrough:
(4) It shall be unlawful for any driver of a truck or truck-tractor to activate or use the unit's engine brake (unmuffled compression brake), on a stretch of Highway 90 in Boutte near I-310, except in an emergency situation.
The foregoing ordinance having been submitted to a vote, the vote thereon was as follows:




And the ordinance was declared adopted this day of , 2019 to become effective five (5) days after publication in the Official Journal.
