Title
An Ordinance to amend Ordinance No. 99-8-4 to allow the Administration to proceed with the necessary topographic surveys, property acquisition services, wetlands mitigation requirements, engineering design services and construction services as necessary to design and construct the West Bank Hurricane Protection Levee.
Body
WHEREAS, Ordinance No. 99-8-4 was approved by the St. Charles Parish Council on August 2, 1999; and,
WHEREAS, Section VI of said Ordinance states that "the Administration shall enter into an agreement (binding) with the Lafourche Levee District and the U.S. Army Corps of Engineers for funding, engineering design, construction, and legal services, if any, and shall contract the U.S. Army Corp of Engineers to manage and construct the levee in a speedy manner after securing the necessary permits from all federal and state agencies"; and,
WHEREAS, the Administration, based on an October 15, 1999 letter received by the Parish from Colonel Thomas Julich, District Engineer, U.S. Army Corps of Engineers, is of the opinion that due to necessary Corps studies required to proceed with design and construction of the levee, delays such construction for at least 4-6 years; and,
WHEREAS, by completing necessary topographic surveys, property acquisition services, wetland mitigation requirements, engineering design services, and construction services by other means, the Administration is of the opinion that this project can start construction much more quickly than contracting with the Corps, thereby providing hurricane protection to the West Bank residents in a more timely fashion.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That Ordinance 99-8-4 is amended to remove Section VI from said Ordinance.
