An Emergency Ordinance to approve Pipe Line License Agreements attached hereto and made a part hereof, by and between The Burlington Northern and Santa Fe Railway Company for the Westbank Regional Wastewater Treatment Plant Projects including but not limited to associated Pumping Stations and Force Mains, St. Charles Parish Project No. 5950301 (Tracking No. 00-21504, Paradis and No. 00-21536, near Luling)

WHEREAS, St. Charles Parish is in the process of constructing a new Wastewater Facility on the West Bank of the Mississippi River and it is necessary to install a pipeline 18" in diameter across or along the rail corridor of Burlington Northern and Santa Fe Railway Co. property on the West Bank at milepost 24.75 (Paradis) and a pipeline 10" in diameter across or along the rail corridor of said railway property on the West Bank at milepost 20.6 (Ama); and,
WHEREAS, the Burlington Northern and Santa Fe Railway Co. has prepared two (2) Pipe Line Licenses, attached hereto and made a part hereof, to provide for said Project;
WHEREAS, time is of the essence as the St. Charles Parish Project No. 5950301 is under time constraints from the Department of Environmental Quality.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS: that the Pipe Line Licenses (Tracking No. 00-21504, Paradis and No. 00-21536, near Luling) by and between Burlington Northern and Santa Fe Railway Co. and St. Charles Parish are hereby approved; and that the St. Charles Parish President is hereby authorized to execute said Railroad License Agreements attached hereto.
