Title
An ordinance to amend Ordinance No. 02-9-23 which approved the Act of Dedication for Evangeline Estates Subdivision, Phase I, Montz, to clarify the dedication of Four J. Lane to Evangeline Road.
Body
WHEREAS, the St. Charles Parish Council adopted Ordinance No. 02-9-23 on September 23, 2002, approving Evangeline Estates Subdivision, Phase I; and,
WHEREAS, although it was the intent of the Developer, R-Squared, L.L.C. to dedicate fee ownership of the entire Four J. Lane from Leigh Lane to Evangeline Road the Act of Dedication, in fact, only dedicated that portion of Four J. Lane located within Evangeline Estates; and,
WHEREAS, on December 21, 2001, R-Squared, L.L.C. did acquire Lots 32 & 33 and a 5' reserve strip of land, in Unit 4, Square 1 of Evangeline City Subdivision, by Cash Sale from Christina & Lauricella, Inc. recorded in COB 596, Folio 431, Entry No. 261784 of the conveyance records of the St. Charles Parish Clerk of Court's Office; and,
WHEREAS, the entrance road to Evangeline Estates Subdivision, Four J. Lane, is in fact constructed over Lots 32, 33, and the 5' reserve strip of land in Evangeline City Subdivision and it is the desire of R-Squared, L.L.C. to include said property in its Act of Dedication; and,
WHEREAS, it is the desire of the Parish Council to approve and accept said Dedication.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That Amendment No. 2 to the Act of Dedication for Evangeline Estates Subdivision, Phase I, Montz, is hereby approved.
SECTION II. That the Parish President is hereby authorized to execute said Amendment on behalf of St. Charles Parish.
