ORDINANCE NO. 00-3-1
Title
An Emergency Ordinance to approve and authorize the Parish President to expropriate approximately 1.2 acres of property from Audubon Barges, Inc. and/or its successors in title to be used for the construction of influent and affluent force mains for the Hahnville Wastewater Treatment Plant.
Body
WHEREAS, St. Charles Parish intends to construct improvements to the Wastewater Plant in Hahnville in conjunction with the Parish Wide Wastewater Regionalization Program for compliance with an Administrative Order of the United States Environmental Protection Agency; and
WHEREAS, it is necessary to expropriate from Audubon Barges, Inc. and/or its successors property to be used as a site for the construction of influent and effluent force mains for the Hahnville Wastewater Treatment Plant.
WHEREAS, the property needed is more fully described in Exhibit A attached hereto.
WHEREAS, in accordance with Chapter 2, Article 1, Section 2-12(V)(d) of the St. Charles Parish Code of Ordinances, an Emergency Ordinance is the appropriate method to approve an emergency ordinance.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS, that the Parish President through the Department of Legal Services, is hereby authorized to expropriate approximately 1.2 acres of property from Audubon Barges, Inc. to be used for the Hahnville Wastewater Treatment Plant; further that the Parish President is hereby authorized to execute all documents necessary to complete said expropriation; and further, that should the expropriation process be necessary, said expropriation should be in accordance with state law.
The foregoing ordinance having been submitted to a vote, the vote thereon was as follows:
