Title
An ordinance to amend the St. Charles Parish Zoning Ordinance of 1981, Appendix A, as amended, Section VI. Zoning district criteria and regulations, in order to permit transmission towers in the OL zoning district as a Special Permit Use.
Body
WHEREAS, the Zoning Ordinance of 1981, as amended, defines Transmission tower as: A structure or framework, usually of a steel lattice construction, principally intended to support radio, cellular, telecommunications, television, electric utility and/or any other electromagnetic transmissions, and receiving antennas and/or equipment (Ord. No. 97-7-4, ? I, 7-7-97); and,
WHEREAS, the Zoning Ordinance of 1981, as amended, also defines Accessory building or structure as: A subordinate structure, not sharing a common wall with the main structure, the use of which is incidental to that of the main structure; and,
WHEREAS, the St. Charles Parish Council wishes to provide for transmission towers to be permitted, for personal use, as residential accessory structures in the OL zone in a way that promotes the public health, safety, and welfare.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That the Code of Ordinances, Appendix A, Section VI.A[I].1.c. Special permit uses and structures [in the O-L zoning district] is hereby amended as follows with new text in underline and deleted text in strikethrough:

The foregoing ordinance having been submitted to a vote, the vote thereon was as follows:
And the ordinance was declared adopted this day of , 2021, to become effective five (5) days after publication in the Official Journal.
