Title
A resolution to request the support of the Legislative Delegation in urging the enactment of Legislation clarifying the law and allowing local Governments to utilize the declaration of taking procedure to acquire property for public projects.
Body
WHEREAS, the Police Jury Association's Resolutions Committee adopted a resolution urging the Louisiana Legislature to enact legislation at the recent Police Jury Association Convention held in Lafayette, Louisiana; and,
WHEREAS, necessary road, highway, drainage and other projects will be unduly delayed if Parishes and cities are not allowed to utilize the quick-take or declaration of taking method to acquire needed property for public purposes; and,
WHEREAS, use of the quick-take procedure by political subdivisions would not only eliminate unnecessary delays but would result in decreased inflation related construction costs; and,
WHEREAS, the quick-take procedure is currently utilized by the State of Louisiana, through the Department of Transportation and Development; and,
WHEREAS, use of the quick-take procedure by Parishes and other political subdivisions would result in no loss of rights for property owners and would ensure that the owners receive just compensation up front as opposed to after protracted legal proceedings.
NOW, THEREFORE BE IT RESOLVED THAT WE THE MEMBERS OF THE ST. CHARLES PARISH COUNCIL AND THE PARISH PRESIDENT, do hereby request the support of the Legislative Delegation in urging the enactment of Legislation clarifying the law and allowing local Governments to utilize the declaration of taking procedure to acquire property for public projects.
BE IT FURTHER RESOLVED, that a copy of this Resolution shall be forwarded to the Police Jury Association of Louisiana and the Legislative Delegation.
