Title
A resolution waiving the five-hundred-foot (500') distance requirement from a protected organization and allowing issuance of a Class B retailer alcohol license for Birdies Dustbowl Store, 12590 River Road, Destrehan, as requested by Nabut Brothers Real Estate, LLC.
Body
WHEREAS, the St. Charles Parish Code of Ordinances Chapter 3 - Alcoholic Beverages, Section 3-1. - Location restrictions., item (a)(3) allows the Parish Council to waive the 500-foot distance required between protected organizations and businesses conducting the retail sale of alcoholic beverages, provided the protected organizations agree in writing; and,
WHEREAS, the location of Birdies Dustbowl Store at 12590 River Road, Destrehan, is within 500 feet of Hope Church St. Charles at 12628 River Road, Destrehan; and,
WHEREAS, Nabut Brothers Real Estate, LLC, provided the letter from Hope Church St. Charles waiving their opposition to the issuance of a Class B retail sales alcohol license for Birdies Dustbowl Store at 12590 River Road, Destrehan.
NOW, THEREFORE, BE IT RESOLVED THAT THE ST. CHARLES PARISH COUNCIL, hereby waive the 500-foot distance requirement for Birdies Dustbowl Store, 12590 River Road, Destrehan, to Hope Church St. Charles, 12628 River Road, Destrehan.
BE IT FURTHER RESOLVED, that the Department of Planning & Zoning shall issue a letter of locational compliance for Birdies Dustbowl Store, 12590 River Road, Destrehan, so that the owner may request a Class B alcoholic beverages business permit through the St. Charles Parish Sheriff.
The foregoing resolution having been submitted to a vote, the vote thereon was as follows:
