RESOLUTION NO. 5337
Title
A resolution asking the Parish Council to support forwarding a letter for an opinion from the St. Charles Parish Legal Advisor regarding whether proper procedures were followed during the April 6, 2006 public meeting of the Planning & Zoning Commission.
Body
WHEREAS, at the April 6, 2006 Planning & Zoning Commission meeting, after introduction of the first agenda item, the applicant or their representative asked that the Commission deviate and allow him to speak last; and,
WHEREAS, deviation allowing the applicant or representative to speak last was granted by the Chairman without a vote, which under Roberts Rules of Order any suspension of the rules, such as deviation, requires a two-thirds majority vote; and,
WHEREAS, public hearing was opened allowing concerned citizens to speak in favor of and/or in opposition of this agenda item; and,
WHEREAS, public hearing was closed after the applicant spoke, infringing on the rights of the Public to ask questions and/or seek clarification on the applicant's remarks.
NOW, THEREFORE, BE IT RESOLVED, THAT WE THE MEMBERS OF THE ST. CHARLES PARISH COUNCIL, do hereby support forwarding a letter for an opinion from the St. Charles Parish Legal Advisor regarding whether proper procedures were followed during the April 6, 2006 public meeting of the Planning & Zoning Commission.

The foregoing resolution having been submitted to a vote, the vote thereon was as follows:

And the resolution was declared adopted this 1st day of May , 2006, to become effective five (5) days after publication in the Official Journal.
