Title
An ordinance to amend Ordinance No. 99-2-9 which approved the Act of Dedication for Fashion Plantation Estates to delete the requirement that the Developers or the Home Owners Association maintain a policy of liability insurance.
Body
WHEREAS, the St. Charles Parish Council adopted Ordinance No. 99-2-9 on February 22, 1999, approving and authorizing the execution of an Act of Dedication for the Fashion Plantation Estates Subdivision; and,
WHEREAS, said Act of Dedication includes a provision that requires either the Developers or the Home Owners Association to carry a policy of liability insurance in the amount of $500,000.00 with St. Charles Parish named as a co-insurer; and,
WHEREAS, the Fashion Plantation Homeowners Association has requested that they be relieved of this requirement by deleting it from the Act of Dedication; and,
WHEREAS, it is the desire of the Parish Council to approve said request.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That Amendment No. 1 to Ordinance No. 99-2-9 adopted on February 22, 1999, is hereby approved deleting section (11) on page six of eight.
SECTION II. That the Parish President is hereby authorized to execute Amendment No. 1 on behalf of St. Charles Parish.
