Title
An ordinance of the Parish of St. Charles providing that the Code of Ordinances, Parish of St. Charles be amended by revising Section II requiring identification and installation of permanent uniform markers on servitudes in St. Charles Parish.
Body
WHEREAS, the St. Charles Parish Council has contracted for the feasibility, design, and installation of a Geographical Information System in St. Charles Parish; and,
WHEREAS, it is imperative that accurate information is secured for creation of the database for the Geographical Information System; and,
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That Section II Administration of the Code of Ordinances of the Parish of St. Charles be amended so that the following language shall be included:
1. DEFINITION
Servitudes/Right of Way
(a) A servitude shall be defined as a right of way that grants use of another's property.
(b) The strip of land over which facilities such as highways, railroads, or utility lines are built.

(a) The legal instrument constituting evidence that grants control or claim to property.
2. Parish Departments shall work with the U. S. Army Corps of Engineers to identify servitudes and rights of way and place permanent uniform markers on said property. Departments shall provide this information to the GIS Administrator. All such property shall be marked on the ground with 4 x 4 x 24" sandstone markers. Public and private utility's servitude, i.e. BellSouth, Entergy, shall also be included.
3. All servitudes and or rights of way in St. Charles Parish including but not limited to roads, water, sewer, drainage, and cable, shall be identified, included in the database and displayed on the GIS maps; and
4. Utility companies and industry shall furnish to St. Charles Parish a copy of their contracts from landowners for righ...
