Title
A resolution to amend Resolution No. 4557, dated September 8, 1998, which approved a Standard General Conditions for the Construction Contracts to be filed once with the Clerk of Court and then referred to in all Construction Contracts entered into by St. Charles Parish.
Body
WHEREAS,      It is the intent of St. Charles Parish that all Construction Contracts entered into by St. Charles Parish shall conform with the Public Bid Law of the State of Louisiana; and,
WHEREAS,      Article 5.2 of Section 00500, General Conditions, of the St. Charles Parish Standard Contract Documents in Resolution No. 4557 addresses retainage but does not specify the retainage amount for a project.
BE IT RESOLVED by the St. Charles Parish Council that we do hereby amend Resolution No. 4557 to change Article 5.2 Section 00500 to read as:
"5.2      Retainage.  Retainage shall be withheld and payments will be made by the OWNER in the payment amount of : 1) ninety percent (90%) of the approved payment applications for projects with contract prices of less than $500,000; or 2) ninety-five (95%) of the approved payment applications for projects with contract prices of $500,000 or greater."
