Title
A resolution requesting the Parish President and Parish Legal Counsel to investigate the Attorney General's Decision and move forward with a decision by February 4, 2003, as to the status of inducting the Community Services Department into the Civil Service System based on the Attorney General's letter dated January 3, 2003, and Resolution No. 5062 adopted November 4, 2002, requesting this opinion.
Body
WHEREAS, the Resolution requesting an opinion indicated the employees' salaries of St. Charles Parish's Community Services Department are partially funded by Parish money and Federal/State money; and,
WHEREAS, according to the Home Rule Charter “there shall be a Classified Civil Service for the Parish of St. Charles based upon merit, efficiency and fitness***. It further provides that “the Classified Civil Service System shall cover all Parish employees”, but then set forth various exceptions. These exceptions include in part elected officials, assistant to the Parish President and, Director and Assistant Director of each Department of the Parish members of boards, agencies, special districts, and all employees thereof, employees on temporary or contractual basis, the Parish Attorney and his legal assistants, and employees paid exclusively with federal funds; and,
WHEREAS, using the reasoning set forth in Attorney General Opinion 81-691 asking whether the Assumption Parish Police Jury could cover various Departments and Agencies under the group health policy; it was concluded that the Community Services Department employees, alth...
