Title
An ordinance to authorize the Parish President to purchase and/or expropriate a servitude from Michael and Betty Foret, the Estate of Henry Williams, the Estate of August Vitter, and Clair Scott.
Body
WHEREAS, The construction of the West Bank Hurricane Protection Levee is paramount to the health, safety and welfare of the residents of St. Charles Parish; and,
WHEREAS, St. Charles Parish has obtained, by donation or sale, the majority of servitudes necessary for the construction of Phase I (Magnolia Ridge) of the West Bank Hurricane Protection Levee; and,
WHEREAS, St. Charles Parish has been unable to obtain necessary servitudes for completion of Phase I (Magnolia Ridge) of the West Bank Hurricane Protection Levee from Michael & Betty Foret, the Estate of Henry Williams, the Estate of August Vitter, and Clair Scott; and,
WHEREAS, It is necessary to purchase and/or expropriate a servitude over certain property owned by the named individuals; and,
WHEREAS, The properties over which the servitudes are needed are located adjacent to Louisiana Highway 633 (Magnolia Ridge Road) in Boutte, Louisiana as shown on the attached drawings; and,
WHEREAS, The purchase and/or expropriation of said servitudes for construction of Phase 1 (Magnolia Ridge) of the West Bank Hurricane Protection Levee is for a public purpose, namely the construction of a levee to ensure the health, safety and welfare of the residents of St. Charles Parish.
THE ST. CHARLES PARISH COUNCIL hereby ORDAINS, that the Parish President through the Department of Legal Services, is hereby authorized to purchase and/or expropriate a servitude over certain lands, adjacent to Louisiana Highway 633 (Magnolia Ridge Road), owned by Michael and Betty Foret, the Estate of Henry Williams, the Estate of August Vitter, and Clair Scott for the purpose of construction of Phase 1 (Magnolia Ridge) ...
