Title
A resolution requesting that the Louisiana Attorney General provide an Opinion as to whether or not a proposed ordinance that was previously reviewed by the Planning Commission and postponed indefinitely by the Parish Council, must be reviewed by the Planning Commission again prior to the same exact proposed ordinance being reintroduced for a vote by the Council.

WHEREAS, St. Charles Parish Home Rule Charter, Article III., Section C. Administrative Departments, Offices and Agencies, 4. Planning and Zoning, c.ii. After review by the Planning Commission, prepare and recommend ordinances designed to effectuate the plans, including, but without limitations, zoning (Appendix A) subdivision and other regulations necessary to insure the application of such regulations to all situations in the Parish. The recommended ordinances, or changes and amendments thereto shall be presented by the President to the Council in accordance with the provisions of general and special laws of the State applicable to St. Charles Parish; and,
WHEREAS, if a proposed ordinance is postponed indefinitely by the Parish Council, it is questioned as to whether the Planning Commission must review the proposed ordinance on which no vote was taken prior to it being reintroduced on the agenda and voted on by the Council.
NOW THEREFORE, BE IT RESOLVED, THAT WE, THE MEMBERS OF THE ST. CHARLES PARISH COUNCIL, do hereby request that the Louisiana Attorney General provide an Opinion as to whether or not a proposed ordinance that was previously reviewed by the Planning Commission and postponed indefinitely by the Parish Council, must be reviewed by the Planning Commission again prior to the same exact proposed ordinance being reintroduced for a vote by the Council.
