Title
An ordinance to revoke and abandon the right-of-way for a certain portion of undeveloped Third Street currently known as Iris Street in St. Rose Subdivision, St. Rose, LA.
Body
WHEREAS, certain properties were laid out for use as a public street in what is identified on a survey by Frank T. Payne, Civil Engineer, dated April 15, 1921 as St. Rose Subdivision, located in Section 39, T13S R9E and Section 44, T12S, R9E; and,
WHEREAS, since dedication, a certain portion of property identified as Third Street, now known as Iris Street, located west of Oak Street, formally known as Avenue A, was never improved as a public street and the property presently has no public use and/or benefit; and,
WHEREAS, the St. Charles Parish Council desires to revoke said property as provided by law in favor of the adjacent property owners; and,
WHEREAS, said portion of property to be revoked is also shown on a survey by Richard Dading, Surveyor, dated June 11, 2005.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That the Act of Revocation of certain properties laid out for use as a public street identified as that certain portion of Third Street, now known as Iris Street, located west of Oak Street, St. Rose, measuring 45' wide along Oak Street by a depth of 114' on a survey by Frank T. Payne, Civil Engineer, dated April 15, 1921 as St. Rose Subdivision, located in Section 39, T13S R9E and Section 44, T12S, R9E is hereby approved and accepted.
SECTION II. That the Parish President is hereby authorized to execute said Act of Revocation in favor of the adjacent property owners in accordance with LA R.S. 48-701.
