Title
An ordinance to approve and authorize modification of the Act of Conservation Servitude for Public Use and Benefit as granted by Willowridge Estates, L.L.C. and Rathborne Land Company, Inc. unto Saint Charles Parish on the 28 day of December, 1999 and to modify the consent decree between the United States of America and Willowridge Estates, L.L.C. and Rathborne Land Company, Inc. in the matter United States of America versus Willowridge Estates, L.L.C. and Rathborne Land Company, Inc. in order to allow for the construction of a levee to traverse the Willowridge Subdivision.
Body
WHEREAS, St. Charles Parish is in need to protect the property owners of the Willowridge Subdivision from flooding of tidal waters of the Gulf of Mexico with the construction of a protection levee; and,
WHEREAS, The Act of Conservation Servitude for Public Use and Benefits between Rathborne Land Company, Inc. and Willowridge Estates, LLC and St. Charles Parish, as per Resolution No.4739 adopted by the St. Charles Parish Council on December 20, 1999, needs modification to allow for the construction of levees along the northern rim of the Conservation Servitude, which is along the southern side of Willowridge Subdivision; and,
WHEREAS, The Consent Decree entered into by United States of America and Willowridge Estates, L.L.C. and Rathborne Land Company, Inc. needs modification to reflect the necessary changes to allow for the construction of a levee along the northern rim of the Conservation Easement/Servitude referenced above.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That the Parish Council hereby authorizes the filing of the necessary documents in the federal lawsuit entitled United States of America v. Willowridge Estates, LLC, Rathborne Land Company, Inc., #99-3489, to modify the consent dec...
