Title
An ordinance to approve and authorize the execution of a License with the Department of the Army License No. DACW29-2-15-41 (Easement) to allow St. Charles Parish Department of Waterworks to utilize 0.31 acres within Bonnet Carre' Spillway for two 2-inch waterlines.
Body
WHEREAS, the Parish currently has an executed Department of the Army License No. DACW29-3-10-190 to allow St. Charles Parish Department of Waterworks to utilize 0.31 acres within Bonnet Carre' Spillway Project, in Sections 6 and 21, Township 12 South, Range 8 East, St. Charles Parish, Louisiana; and,
WHEREAS, said license was for a period of five (5) years from May 17, 2008 through May 16, 2013; and,
WHEREAS, the Department of the Army has proposed to renew said License by issuing Department of the Army License No. DACW29-2-15-41 for a term of fifty (50) years; and,
WHEREAS, it is the desire of the Parish Council to approve said License renewal.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That the Department of the Army License No. DACW29-2-15-41 to allow St. Charles Parish Department of Waterworks to utilize 0.31 acres within Bonnet Carre' Spillway Project, in Sections 6 and 21, Township 12 South, Range 8 East, St. Charles Parish, Louisiana is hereby approved and accepted.
SECTION II. That the Parish President is hereby authorized to execute said License on behalf of the St. Charles Parish Department of Waterworks.
The foregoing ordinance having been submitted to a vote, the vote thereon was as follows:
And the ordinance was declared adopted this ______ day of __________, 2016, to become effective five (5) days after publication in the Official Journal.
