ORDINANCE NO. 13-10-3
Title
An ordinance approving and authorizing a Home Occupation under the operation of Michael L. Hamilton- "Destrehan Repairs" - a gunsmith- at 304 Amelia Street, Destrehan.
Body
WHEREAS, the St. Charles Parish Code of Ordinances, Appendix A, Section XXII requires that home occupations needing licensure must be approved by the Parish Council; and,
WHEREAS, the home occupation permit requested by Michael L. Hamilton for "Destrehan Repairs," a gunsmith, requires licensing by the Bureau of Alcohol, Tobacco, Firearms, and Explosives; and,
WHEREAS, at a regular meeting on September 5, 2013, the St. Charles Parish Planning and Zoning Commission recommended denial of the home occupation; and,
WHEREAS, the Planning and Zoning Department recommended approval with the following stipulations:
1. The applicant shall obtain the required federal license prior to obtaining an occupational license for a gunsmith,
2. No transfer of firearms occur at the residence at any time,
3. That there shall be no guns for sale, and that all guns on the premise shall be locked in a locked safe or cabinet when on the premise when not being worked on,
4. That no guns shall be delivered to the resident by customers.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That the home occupation permit requested by Michael L. Hamilton to operate "Destrehan Repairs"-a gunsmith-is approved.
SECTION II. That upon receipt of Michael L. Hamilton's Federal Firearms license, the Department of Planning & Zoning is authorized to issue a home occupation permit to operate "Destrehan Repairs" -a gunsmith- at 304 Amelia Street, Destrehan.
SECTION III. That the approval of the home occupation permit is contingent upon the following stipulations:
