Title
An ordinance to eliminate the additional setbacks imposed on cemetery and mausoleums in the Special Provisions Section of the O-L Zoning District.
Body
WHEREAS, the current zoning ordinance requires a setback of 50' for all graves from all property line; and,
WHEREAS, current Open Land Setbacks for all other uses are 35' front, 10' side and 20' rear; and,
WHEREAS, the additional requirements for gravesites are inconsistent with setbacks in the rest of the zoning ordinance; and,
WHEREAS, nearly every cemetery built or expanded in St. Charles Parish in the last 10 years has had difficulty meeting the 50' setback; and,
NOW, THEREFORE, THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
Section 1 That Appendix A. Section VI.A.[1].3.e is amended to read as follows:
e. Cemeteries and mausoleums:
(1) All graves must be set back at least fifty (50) feet from all property lines.
(2) (1) All cemetery or mausoleum sites must have a minimum street frontage of one hundred (100) feet.
