Title
A resolution providing mandatory supporting authorization to Esperanza Land C. c/o Edward A Dufresne, Jr. to endorse the positive Planning & Zoning Commission decision regarding PZR-2001-33, allowing a waiver from subsurface to above ground utilities (electrical), and a waiver to the required streetlight installation. The developer is hereby authorized to proceed with the plat as presented at the regular meeting of June 7, 2001, which is identified as Case No. PZS-2001-33.
Body
WHEREAS, The above ground power lines are existing and not added as part of the construction of the subdivision; and,
WHEREAS, Entergy has stated in a submitted letter that the existing power lines are feeder lines; and,
WHEREAS, The letter states that it is normal to use overhead construction when tying into existing overhead feeder lines; and,
WHEREAS, The letter states that new feeder line will serve several purposes, including Ashton Plantation Estates Subdivision, and the proposed civic center; and,
WHEREAS, The use of existing overhead poles for streetlights will reduce visual clutter along Sugarland Parkway; and,
WHEREAS, Sugarland is a commercial subdivision, not a residential subdivision.
WHEREAS, the St. Charles Parish Zoning Ordinance of 1981 (as amended) requires both Planning & Zoning Commission approval and a supporting resolution of the Parish Council for a waiver to required subsurface utilities and required streetlights.
NOW, THEREFORE, BE IT RESOLVED THAT THE ST. CHARLES PARISH COUNCIL, does hereby provide this supporting resolution for Construction Approval of Sugarland Subdivision with waivers to the required underground utilities and streetlight installation, as outlined in the Subdivision Approval application contained in Planning & Zoning Commission Case PZS-2001-33.
