Title
A resolution providing mandatory supporting authorization to endorse the positive Planning & Zoning Commission decision regarding Special Permit Use application PZSPU-2007-04, which would allow the expansion of a construction debris landfill on at 69.79 acres of Tract H-2 in Killona, La. as requested by Killona Ventures, LLC.
Body
WHEREAS, the St. Charles Parish Zoning Ordinance of 1981 requires both Planning & Zoning Commission approval and a supporting resolution of the Parish Council for the expansion of a construction debris landfill; and,
WHEREAS, the developer, Killona Ventures, LLC c/o Wade Scott wishes to expand a construction debris landfill at 69.79 acres of Tract H-2 in Killona, La.
NOW, THEREFORE, BE IT RESOLVED THAT THE ST. CHARLES PARISH COUNCIL, does hereby provide this supporting resolution for the expansion of a construction debris landfill, as outlined in the Special Permit Use application contained in Planning & Zoning Commission Case PZSPU-2007-04 subject to the following condition:
Regulated asbestos-containing material (“RACM”), as presently defined by the Louisiana Department of Environmental Quality (“LDEQ”), may not be deposited into this landfill. Only those materials which were defined as construction and demolition debris in the Regulations published by the LDEQ prior to August 29, 2005 may be deposited into this Construction Debris Landfill.
