An ordinance to amend Ordinance No. 99-4-4 approving a DNR Cooperative Agreement for the Davis Pond Freshwater Diversion Project to include a provision to address DNR's Annual Fiscal Funding.
Body
WHEREAS, Ordinance No. 99-4-4 approved and authorized the execution of DNR Cooperative Agreement No. 2512-99-05 by and between St. Charles Parish and the Louisiana Department of Natural Resources for the operation, maintenance, repair, replacement, and rehabilitation of the Davis Pond Freshwater Diversion Project; and,
WHEREAS, DNR wishes to include a provision to provide that continuation of the contract is contingent on appropriation of funds by the Legislature.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That the following language shall be inserted in DNR Cooperative Agreement No. 2512-99-05:
7. Fiscal Year Funding:
The continuation of this contract is contingent on the appropriation of funds to fulfill the requirements of the contract by the legislature. If the legislature fails to appropriate sufficient monies to provide for the continuation of the contract, or if such appropriation is reduced by the veto of the Governor or by any means provided in the appropriations act to prevent the total appropriation for the year from exceeding revenues for that year, or for any other lawful purpose, and the effect of such reduction is to provide insufficient monies for the continuation of the contract, the contract shall terminate on the date of the beginning of the first fiscal year for which funds are not appropriate.
