Title
An ordinance revoking a Special Permit Use for automobile sales in a C-2 zoning district on Lot 1, Autin Subdivision, 16830 Highway 90, Des Allemands.
Body
WHEREAS, the St. Charles Parish Zoning Ordinance of 1981 requires Special Permit Use approval from the Planning & Zoning Commission to permit automobile sales in a C-2 zoning district; and,
WHEREAS, on October 12, 2023 case number 2023-6-SPU was approved by the Planning Commission to permit automobile sales in a C-2 zoning district on Lot 1, Autin Subdivision, 16830 Highway 90, Des Allemands as requested by Khawaja Omer; and,
WHEREAS, the Planning Commission's approval was granted with stipulations as recommended by Planning and Zoning, including keeping the parking, vehicular circulation areas, and inventory storage in conformance with Appendix A., Section VII. - Site Design Requirements and ensuring vehicle inventory is confined to the boundaries of the developed parking area and must not encroach into the Autin Lane right-of-way; and,
WHEREAS, since the approval of this Special Permit Use multiple violations and complaints have been recorded, including direct violation of the approved stipulations; and,
WHEREAS, Code Enforcement has made several attempts to work with the business owner to follow the approved site plan and have the violations corrected, only for such violations to return, prompting regular site visits and continued conversations with the business operator; and,
WHEREAS, as violations continued with the operation of this business the Department of Planning and Zoning was prompted to initiate the Special Permit Use revocation process as per Appendix A., Section IV. - General Provisions., 9. Special exception uses and special permit uses., H. Revocation; and,
WHEREAS, the Planning and Zoning Commission recommended in favor of the revocation at its regular meeting ...
