Title
An ordinance to suspend the enforcement of the Preliminary Digital Flood Insurance Map elevation requirements for non-repetitive loss properties for a period of 12 months from the passage of this ordinance, for structures damaged or destroyed by Hurricane Ida.
Body
WHEREAS, the Zoning Ordinance of 1981, Section XX.C.2 as amended, requires that new construction and properties significantly improved or damaged (greater than 50% of the structure's value) be elevated according to the November 9, 2012 report titled "The Flood Insurance Study for the Parish of St. Charles" commonly referred to as the Preliminary DFIRM; and,
WHEREAS, the Preliminary DFIRM is generally 2 to 6 feet higher than homes in existing neighborhoods; and,
WHEREAS, forcing so many homes to elevate due to "significant damage" could create drainage issues as the changes were meant to be gradual as new homes and neighborhoods are built; and,
WHEREAS, forcing so many homes to elevate due to "significant damage" where no or minimum flood risk exist would be a burden on homeowners and would drastically slow the recovery from Hurricane Ida.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That the enforcement of the Preliminary Digital Flood Insurance Map elevation requirements for non-repetitive loss properties is hereby suspended for a period of 12 months, for structures damaged or destroyed by Hurricane Ida, and to be effective immediately.
The foregoing ordinance having been submitted to a vote, the vote thereon was as follows:
And the ordinance was declared adopted this day of , 2021, to become effective immediately upon adoption.
