Title
An ordinance to amend Ordinance No. 13-3-14 to direct and mandate that the Parish President execute the Agreement approved therein.
Body
WHEREAS, on March 25, 2013 the St. Charles Parish Council adopted Ordinance No. 13-3-14 approving and authorizing an agreement between Tauzin Consultants, LLC and St. Charles Parish for governmental affairs representation before the state and federal governments; and,
WHEREAS, Ordinance No. 13-3-14 was disapproved and returned by the Parish President on April 1, 2013; and,
WHEREAS, On April 8, 2013, Ordinance No. 13-3-14 was presented to the Parish Council, along with the Parish President's Veto Message, and by vote of the St. Charles Parish Council, the Parish President's Veto of Ordinance No. 13-3-14 was overridden; and,
WHEREAS, Section II of said Ordinance authorizes the Parish President to execute its Agreement, nonetheless, the Parish President has refused to follow the express directive contained therein, rejecting the duty to faithfully execute and carry out said Ordinance, in violation of the St. Charles Parish Home Rule Charter; and,
WHEREAS, The St. Charles Parish Council is obligated to enforce its official actions to ensure the integrity of the Charter, therefore
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That Section II of Ordinance No 13-3-14 is hereby amended to delete the current Section II and replace it as follows:
“SECTION II. That the Parish President is hereby directed and mandated to execute said Agreement on behalf of St. Charles Parish and to perform all obligations of St. Charles Parish under said Agreement.”
