Title
An ordinance approving and authorizing the execution of an Act of Mutual Dissolution and Revocation of Donation by St. Charles Parish to Rathborne Land Company, L.L.C. for that certain parcel of property adjacent to the Rathborne Park located at 702 Lakewood Drive, Luling, Louisiana.

WHEREAS, Ordinance No. 19-12-9 adopted on December 2, 2019, by the St. Charles Parish Council, approved and authorized the execution of an Act of Donation by Rathborne Land Company, L.L.C. to St. Charles Parish for a certain parcel of property adjacent to the Rathborne Park at 702 Lakewood Drive in Luling for use as additional parking for the Rathborne Park; and,
WHEREAS, on December 5, 2019, St. Charles Parish through the Parish President executed the Act of Donation as Donee of said property; and,
WHEREAS, St. Charles Parish as Donee and Rathborne Land Company, L.L.C. as Donor agreed that in the event the Donee does not commence construction of a parking lot on the subject property within two years of the date of said Donation, said property shall revert to Donor with an Act of Donation to be passed within 90 days of written demand by Donor; and,
WHEREAS, St. Charles Parish as Donee and Rathborne Land Company, L.L.C. as Donor by mutual agreement extended the time within which St. Charles Parish should commence construction of said parking lot to a period within three years of the date of said Donation; and,
WHEREAS, the subject property is in the footprint of the federally approved levee alignment, said location preventing the permitting of the property by the United States Corp of Engineers for its use as a parking lot; and,
WHEREAS, the delays to commence construction of the parking lot have now lapsed and construction of said parking lot has not commenced; and,
